Obviousness part 2 video

This video was very good at explaining what prior art is in regards to patents. When dealing with obviousness many people do not understand that the prior art will ultimately decide whether you will get a patent or not. In this video the who process of obviousness is broken down into smaller pieces that make the idea of obviousness easier to understand. The coolest part about this video is the venn diagram which gives examples of prior art search!

Assignment #7 Obviousness

After doing some research and watching some youtube clips on obviousness I have a better understanding of patents in general. obviousness basically means asking whether there is any combination of prior art references when put together. In addition there are four major steps to determine if an invention is obvious.  

(1) Determine the scope and content of the prior art
(2) Ascertain the differences between the claimed invention and the prior art 
(3) Resolve the level of ordinary skill in the pertinent art
(4) Consider objective indicia of non-obviousness 

Overall obviousness relies a lot on prior art and and this can make obtaining a patent very tricky. If any of your claims can be refuted by prior art your invention will most likely not get the patent.
